We received news this morning that the U.S. Court of Appeals for the Federal Circuit denied Blackboard's combined Petition - one for a Rehearing and one for a Rehearing en banc. ...There's no opinion - just a listing on the Federal Circuit's website. ...We expect that the Court will be issuing its mandate in the near future.
The effect? All positive for Desire2Learn:
1. We expect that Judge Clark will dissolve the injunction (he's already suspended it)
2. We'll be receiving repayment of the judgment we paid to Blackboard - plus interest - plus costs associated with the action
3. We're delighted to put this chapter behind us, once and for all!"
Will our Blackboard fees be going up even more?
